General conditions of Miss Beaver, version established in Bruges and valid as from 1.1.2012
1. General
1.1 These general conditions apply on all offers of Miss Beaver . The conditions are accessible for the general public and on the internet site of Miss Beaver. Per request we can send you a written .
1.2 By placing an order you indicate that you agree with the shipping- , delivery and payment conditions . Miss Beaver preserves itself the right to change shipping- , delivery and payment conditions after expiration of the respective timelines .
1.3 Unless differently agreed in written correspondence the general or specific conditions through third parties are not recognised by Miss Beaver .
1.4 Miss Beaver guarantees that the provided product satisfies and answers to the agreement and to the specifications mentioned in the offer.
2. Delivery & shipping
2.1 Delivery takes place as long as the stock stretches.
2.2 Within the framework of the rules of the ‘purchase on distance’, Miss Beaver will carry out orders at last within 15 days. If this is not possible (because it is not ordered on stock or no longer deliverable), or other reasons that cause delay, or an order is not possible or are carried out partially only, then the consumer will receive latest within 15 days after the order a specific notice and in that case the consumer holds the right to cancel the order free of charge.
2.3 The shipping duty of Miss Beaver, subject to counter-evidence, have been satisfied as soon as products provided by Miss the Beaver have been offered at least one time to the consumer. At delivery to your home adress the report of the carrier , implying the non-acceptance, to complete proof of the shipping by Miss Beaver .
2.4 All periods called on the internet site are indicative. The mentioned delivery & shipping periods are indicative and therefore no rights can be deducted .
3. Prices
3.1 Prices will not be raised within the duration of the offer, unless legal measures make this necessary or if the manufacturer increases the prices passes.
3.2 All prices on the site are subject to typo’s and text-errors. For the impact of these errors no liability is accepted.
3.3 All prices on the site are in euro and VAT included.
4. Testperiod/Right to return
4.1 If a consumer bought products, in accordance with the law on ‘purchase on distance’ (Article 7:5 BW), the consumer holds the right to return the pruchased goods within a period of 7 working days without any reason. This period starts the moment the ordered product(s) has/have been delivered. If the consumer after this period hasn’t sent the provided products back to Miss Beaver , the purchase is a fact is. The consumer is obliged , before proceeding to returning the products, to send a report within the period of 7 working days after delivery , in writing , infomring Miss Beaver of the return. The consumer must prove that the provided product(s) has/have been returned swiftly, for example by means of a proof of mail delivery. Returning products must occur in original packing (including accessories and associated documentation) and in good un-sused condition . If the products have been used by the consumer, burdened or in any way are damaged , the right to dissolution or return becomes obsolete. Taking into account what has been stipulated in the previous sense, Miss Beaver carries care that it is paid back within 30 days after good reception of the returns, the complete purchase amount without shipping costs. The consumer is entirely accountable for sending back the
4.2 The ‘right to return’ does not apply for:
• services of which the implementation has started, with approval of the consumer, for the period of seven working days
• goods or services of which the price is bound to the financial market, on which the supplier has no influence
• goods which have been manufactured according to specifications of the consumer, for example a tailor-made job, or that has a clear personal character
• for goods or services which cannot be sent back by their nature, for example concerning. hygiene or that rapidly can spoil or become obsolete
5. Data management
5.1 if you place an order at Miss Beaver, your data is incorporated in the customer files of Miss Beaver. Miss Beaver sticks to the law personal privacy ; recordings and your data will not be shared with third parties. See our privacy policy.
5.2 Miss Beaver respects the privacy of the users of the internet site and ensures for a confidential treatment of your personal details.
5.3 Miss Beaver uses in some cases of a mailing list. Each mailing contains instructions to remove yourself of this list.
6. Warranty
6.1 Miss Beaver guarantees that its provided products fullfil the requirements of usability, reliability and life span such as these at the purchase have been meant, and stands for the factory guarantee of the product provided to you.
6.2 The warranty period of Miss Beaver is in line with the factory waranty period. Miss Beaver is however never responsible for the eventual aptitude of the product for each individual application by the consumer, nor for possible recommendations regarding. the use or the application of the products.
6.3 The consumer is obliged to check the provided products upon receiving . If it appears that the delivered products are damaged or incomplete , then the consumer must (before returning the products to Miss Beaver) communicate the imperfections in writing to Miss Beaver . By mistake delivered or damaged products Possible must be communicated in writing at the latest up to maximum 2 days after delivery to Miss Beaver.. Returns of the goods must occur in original packing (including accessories and associated documentation) and in good condition if wrongly delivered . Using the products even after observation of damage after and/or resale after observation of damages , makes the right to return and complain entirely obsolete .
6.4 When complaints of the consumer have been approved by Miss Beaver , Miss Beaver has the choice to reimburse the returned prodycts, free of charge replaced or agree with the consumer a written regulation concerning the replacement. The amount shouldnt surpass the liability of the returned products at Miss Beaver or the amount covered to the maximum in the case of liability insurance of Miss Beaver. Every liability of Miss Beaver . Any other form of damage and/or claim is excluded, among which indirect damage and/or consequence damage and/or profit damage .
6.5 Miss Beaver can not be held responsible for damage by third parties such as delivery companies .
6.6 This warranty does not apply if:
A) and as long as the consumer has not paid Miss Beaver
B) the consumer has repaired and/or reworked the provided products him/herself and/or by third parties .
C) the delivered products have been exposed to abnormal circumstances or has been otherwise carelessly treated and/or has been treated in conflict with the indications of Miss Beaver and/or instructions for use on packing;
D) The inadequacy , entirely or partially , of the goods due the consequence of regulations which the government and/or suppliers has put or will put with respect to the nature or the quality of the applied materials.
7. Offers
7.1 Offers are without engagement, unless it has been mentioned differently in the offer.
7.2 At acceptance of an offer by the purchaser, Miss Beaver holds the right to revoke tthe offer within the period of 3 working days after reception of that acceptance or to change the products .
7.3 Verbal promises hold Miss Beaver accountable only after these have been explicitly confirmed in writing.
7.4 Offers of Miss Beaver do not apply automatic to re-orders.
7.5 Miss Beaver cannot be obliged to deliver its offer if the consumer should have understood that the offer, or a component of it, contained a clear mistake or tekst-error.
7.6 Supplements, modifications and/or closer appointments are only effective, if in writing corresponded and confirmed .
8. Agreement
8.1 An agreement between Miss Beaver and a customer is effective after an order task and/or purchase has been assessed by Miss Beaver on feasibility.
8.2 Miss Beaver preserves itself the right for ,without any reason, not accepting orders or exclusively accept under the condition that the sending occurred by means of payment in advance (Paypal).
9. Images and specifications
9.1 All images; photograph, drawings etc.; among other things. data concerning weights, dimensions, colours, images of labels, etc. on the internet site of Miss Beaver apply only approximately, is indicative and can not be reason to damage-claims or dissolution of the agreement.
10. Supremacy
10.1 Miss Beaver is not responsible, if and as far as its obligations cannot be completed as a result of supremacy.
10.2 Under supremacy it is understood each strange cause, as well as each circumstance, which for its risk does not belong to Miss Beaver. Delay , technology, transport difficulties provided by our subcontractors, jammings in the Internet, jammings in electricity, jammings in e-mail movement and jammings or modifications, third parties, strikes, government measures, delays in the delivery, failures of suppliers and/or manufacturers of Miss Beaver as well as of assisting people , sickness of staff, lacks in aid or means of transport are considered explicitly as supremacy.
10.3 Miss Beaver preserves itself in the case of supremacy to suspend its obligations and even is enitled to annul the purchase entirely or partially, or to proceed in the way that the contents of the agreement are as such modified that implementation remains possible. Under no circumstances can Miss Beaver accountable for any fines or pay damages.
10.4 If Miss Beaver at the start of any supremacy already partial fullfilled its obligations, Miss Beaver is entitled to invoice the still to be delivered part separately to the consumer ,. The consumer is obliged to pay the invoice as if it concerned a separate purchase. This is not possible if the remaining deliverable part has no independent value.
11. Liability
11.1 Miss Beaver is not liable for damage to other objects due to irresponsible application of the products. Read the indications on packing and/or consult our Internet site for correct use.
12. Property reservation
12.1 Property of all by Miss Beaver sold products to the consumer and provided remains at Miss Beaver as long as the consumer of Miss Beaver did not complete the account and/or purchase and/or simultaneous agreements have not been satisfied, and as long as the consumer has’nt progressed in terms of satisfying the agreement with Miss Beaver, among which understood progress to the point of pay for, interests not yet paid , compliance with such obligations and costs has not been completed, and other potential variations as meant in Article 3:92 BW.
12.2 Cases which with the property reservation fall can be resold only within the framework of a normal company exercise and, provided by Miss the Beaver, never as a tender, loan nor payment.
12.3 The consumer is not authorized ,within the property reservation, to pawn nor burden the products taht can be categorized under this pledge .
12.4 The consumer agrees at this point gives unconditional and irrevocable authorisation to Miss Beaver or by Miss Beaver to appoint a third partie in all cases in which Miss Beaver wants to assert its property rights, to enter all those places where its properties will be and then and there take the products back.
12.5 If third parties , not appointed by Miss Beaver , want to confiscate the products that fall within the property reservation of Miss Beaver , the consumer is obliged to inform Miss Beaver in such a fast way as can be reasonably expected.
13. Appropriate right/competent judge
13.1 To all agreements applies the Belgian right.
13.2 Disputes, derived from an agreement between Miss Beaver and purchaser, who in mutual consultation cannot be solved, takes the competent judge within the district Brugge knowledge, unless Miss Beaver prefers to appoint a competent judge of the place of residence of the purchaser to submit the dispute, with exception of those disputes which belong to the competentie of the cantonal judge.
